Terms of Service

1. The agreement

These Terms of Service ("Terms") are a contract between you and Calgie LLC ("FC Pickup," "we," "us") covering the FC Pickup mobile apps, the fcpickup.app website, and related services (together, the "Service"). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you don't agree, don't use the Service.

You must be at least 13 years old (or the higher minimum age your region requires) to use FC Pickup. If you use the Service on behalf of an organization, you represent that you can bind it to these Terms.

2. Your account and nickname

You're responsible for your account, for the accuracy of the information on it, and for keeping your credentials secure. Tell us immediately at support@fcpickup.app if you suspect unauthorized access.

Nicknames are unique and permanent — choose one you can live with. We may reclaim or change a nickname that is offensive, misleading, impersonates someone, or infringes someone's rights.

3. Hosts, groups, and games

Hosts (and up to 3 co-admins per group) run their groups: they approve join requests, schedule games, manage waitlists, assign teams, record scores, correct attendance before results finalize, and may lift automatic suspensions within their group.

FC Pickup is software, not a league. We don't organize games, book venues, vet players, supervise play, or provide insurance. Hosts and players are solely responsible for their conduct, their compliance with venue rules and local law, and their own safety. Pickup soccer is a physical activity with inherent risk of injury; you participate at your own risk.

4. Records, ratings, and automated features

The following are automated features of the product, computed from game activity: check-in windows around kickoff; no-show flags (issued when a player who RSVP'd "going" never checks in during the window, or drops out after kickoff); automatic group-level suspension after 3 flags in 30 days; W-D-L records and rank tiers earned only by checked-in, team-assigned players; peer skill ratings applied anonymously in aggregate after a quorum; and results that finalize and lock 24 hours after kickoff (unreported games record as a 0–0 draw). Hosts can correct attendance and scores before finalization; after it, records are locked.

You may not manipulate these systems — no fake or duplicate accounts, rating manipulation or coordinated rating attacks, falsified check-ins, or result collusion. We may correct or void records produced by manipulation and may suspend accounts involved.

5. Subscriptions and purchases

Host+ is a subscription (billed monthly or annually at the price shown in the app) purchased through the App Store or Google Play. New hosts get a 30-day free trial that requires no payment method and does not convert automatically — no card is charged when it ends. When the trial ends, you choose whether to subscribe; until you do, the groups you host are frozen. Once you purchase Host+, the subscription auto-renews through your store until you cancel in your store's subscription settings; cancellation takes effect at the end of the current period. Refunds are handled by the store under its policies. If your Host+ subscription lapses, groups you host are frozen — visible, but no new activity — and after 90 days of lapse they are archived. Nothing is deleted; resubscribing restores your groups.

Player+ is a one-time purchase, not a subscription. It's tied to your account and restorable on your devices via "Restore purchases." The free tier limits players to 3 concurrent group memberships; Player+ removes that limit and adds a verified badge and rating requests.

Purchases are processed by Apple or Google; we never receive your payment details.

6. Acceptable use

Don't: harass, threaten, or discriminate against anyone in chat or anywhere in the Service; post unlawful, infringing, or sexually explicit content; spam invite links; access another user's account; probe, scrape, reverse-engineer, or interfere with the Service; resell or white-label the Service; or use it for anything other than organizing and playing pickup sports. We may remove content, revoke invite links, and suspend or terminate accounts that violate this section.

7. Your content

You own the content you post (chat messages, photos, group names and descriptions). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit that content solely as needed to operate and improve the Service. Group and game names, times, venue names, and player counts may appear in public invite-link previews. This license ends when your content is deleted, except for anonymized game results retained as described in the Privacy Policy and residual backup copies.

You're responsible for having the rights to what you post. We respond to copyright complaints sent to support@fcpickup.app and may terminate repeat infringers.

8. Our property

The Service — including the apps, site, design, logos, and software — belongs to Calgie LLC or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the apps on devices you own or control, subject to these Terms and the app store's rules. No other rights are granted.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't warrant that the Service will be uninterrupted, error-free, or that records will be free of user manipulation. We are not responsible for what happens at games — including injuries, disputes, theft, or property damage — or for the conduct of any host or player.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALGIE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) US $50 AND (B) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions don't allow certain exclusions or limits, so parts of this section may not apply to you.

11. Indemnification

You'll defend and hold Calgie LLC harmless from claims and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your conduct at games, or your violation of these Terms or the law.

12. Disputes: arbitration and class-action waiver

Please read this section carefully — it affects your rights.

Informal resolution first. Before filing a claim, email support@fcpickup.app with a description of the dispute; we'll try to resolve it within 60 days.

Binding arbitration. If we can't, any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in English, remotely or in the county where you live. The Federal Arbitration Act governs this section.

Exceptions. Either party may bring an individual claim in small-claims court, or seek injunctive relief in court for infringement or misuse of intellectual property.

Class-action waiver. Disputes must be brought individually — not as a plaintiff or class member in any class, consolidated, or representative proceeding. Both parties waive the right to a jury trial.

Opt-out. You may opt out of this arbitration agreement by emailing support@fcpickup.app with the subject "Arbitration opt-out" within 30 days of first accepting these Terms; opting out does not affect the rest of the Terms.

13. Termination

You can stop using the Service or delete your account anytime (Settings → Account → Delete account). We may suspend or terminate your access if you violate these Terms, with notice where practical. Sections that by their nature survive — including 7 (license to retained anonymized data), 9–12, and 14 — survive termination.

14. App store terms

Your use of the iOS app is also subject to Apple's standard EULA, and the Android app to Google Play's terms. Apple and Google are not parties to these Terms, have no obligation to provide support or maintenance for the Service, and are not responsible for claims relating to it; Apple (and its subsidiaries) is a third-party beneficiary of these Terms with the right to enforce them against you for the iOS app.

15. Changes, governing law, and contact

We may update these Terms; material changes are announced in the app before they take effect, and continued use after that means acceptance. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules; where arbitration doesn't apply, disputes go to the state or federal courts of Delaware, and you consent to their jurisdiction. If any provision is unenforceable, the rest remains in effect. These Terms plus the Privacy Policy are the entire agreement between us regarding the Service.
